According to Article 3 of Criminal Code of the Republic of China: “This Code shall apply to an offense committed within the territory of the Republic of China.” Therefore, if any foreigner commit offence in Taiwan, the laws and regulations of the Republic of China shall apply. Marihuana is listed as Category two narcotics. If any foreigner abuse marihuana, he/she breaches the Narcotics Hazard Prevention Act, and he/she shall be punished with a maximum three-year fixed-term imprisonment.
